terms of service

I. GENERAL TERMS

I reserve the right to refuse or discontinue a commission at any time.
Disrespectful behavior will not be tolerated and your commission will be cancelled if it occurs.
The terms outlined here may vary slightly depending on the type of commission.

II. REVISIONS

at every stage you will have a chance to request changes and revisions, the extent to how much you can request to be changes decrease per stagei categories each stage on these criteria do note depending on the type of commission some of these stages won't be used in practice.
- initial concepting, in this stage i will provide a couple(2-6) rough sketches, you can choose one of these i provide if none of them are to satisfaction we can go back to the drawing board.
- sketching, i will provide the sketch post the concepting stage we can then once again go through and you as the client can request changes once again, this is the last chance to ask for any large changes.
- line art, i will once again provide the line art at this point you can request minor changes / point out any mistakes i may have made.
- colouring, depending on how clear the reference is you have provided me we can go through a couple rounds of me providing the current stage of colouring for approval
- shading, i will unless previously discussed provide you with a couple mockups for the lighting and we can keep going until you’re satisfied with it.

III. COPYRIGHT / USAGE POLICY

I, acrayday, claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:- Promote myself with it everywhere
- Publish books with it (artbooks, etc.)
- Display it everywhere to my liking (website, social media, etc.)
- Post it wherever I want** With most if not all artwork I will still ask if the buyer is alright with posting it, unless I don't have a given example of said commission type I will try to respect their request.The buyer is allowed to:- Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
- Print the artwork and claim the character(s) as their own, but not the artwork itself.
- Use the artwork to promote themselves. credit is required if you wish the use the unwatermarked version of the artwork
- Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.The following is considered copyright infringement:- Reproducing/using the copyrighted artwork commercially - means making money off it in any way.**
- Claiming the artwork as your own
- Altering the artwork without my consent
- I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).*if you wish to use the artwork in such a way we can discuss extra compensation for myself, pre commission being agreed upon
*if the artwork is sold in an adopt or an oc trade on sites such as Toyhouse exceptions apply.
It is the buyer’s responsibility to inform the recipient of these terms.

IV. REFUND POLICY

- if you wish to refund post the commission starting you will be provided with all current completed parts of the commission and will only receive a partial refund based on the unfinished work*
- If for any reason I am unable to start your commission you will receive a full refund.*
- If you cancel your order before I started it, you can get a full refund.*
- If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
- If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.*all refunds are subject to paypal and potentially ko-fi fees, which you as the buyer will lose in the refund, unless the refund is started because of my personal circumstances where i will try to fully refund to the best of my abilities
